Resort Expertise

 

Our experience extends to a diverse range of resort projects both within and outside the United States, encompassing hotels, condominiums, villas, resort rental properties, primary and secondary homes, and a variety of vacation ownership products, as well as golf, beach club, cultural, marina, theme park, and other recreational and entertainment components.

 

We have comprehensive experience in dealing with the issues unique to resort communities, including:

  • Integration of hotel, vacation ownership, and resort rental components into the overall community association structure
  • Long-term ownership of various resort amenities
  • Long-term control in projects with few resident property owners
  • Creation of operators' associations and similar mechanisms supported by 
    the owners and operators of resort properties to promote the overall project 
    as a destination resort

Governing Structure and Statutory Compliance

 

We provide our standard range of services in connection with the creation of a governing structure for the overall resort and the individual resort components, from condominium hotels to vacation ownership plans to club membership programs.

 

We also ensure compliance with state and federal land sales laws in order to enhance marketability of the project. Many of our clients' resort developments are located in jurisdictions not governed by U.S. laws, and, as a result, we are familiar with the myriad of potential issues that arise in dealing with foreign laws. 

 

We frequently work with local counsel to understand local law issues and then consult with the development team to establish an overall structure for the resort. Our goals are:

  • Preserving flexibility
  • Protecting the marketability of unsold property
  • Maximizing the value of each parcel
  • Capitalizing on the increase in value of undeveloped land resulting from each new phase of development
